These Terms of Use govern your access to and use of BlueByNinety.com, Club90, the Blue By Ninety message board and other services operated by Blue By Ninety.
By accessing or using Blue By Ninety, you agree to these Terms.
Editorial Content
Blue By Ninety provides sports news, commentary, analysis, recruiting coverage, podcasts and related content for informational and entertainment purposes.
Sports information, schedules, recruiting information, rankings and other information may change. While we work to provide accurate information, Blue By Ninety does not guarantee that every piece of information will always be complete, current or error-free.
Opinions expressed by writers, contributors, podcast hosts or community members are their own unless otherwise stated.
Club90 Membership
Certain content and community features require an active Club90 membership.
Available membership plans, pricing and billing intervals will be displayed at checkout. Memberships may automatically renew according to the terms presented when you subscribe.
Members are responsible for maintaining accurate account and payment information.
Blue By Ninety may modify membership benefits or pricing for future billing periods. Any material changes will be communicated when required.
Cancellation
Members may cancel their subscription through their Blue By Ninety account or another cancellation method made available by Blue By Ninety.
Unless otherwise stated at checkout, cancellation prevents future renewal but does not necessarily result in a prorated refund for time already purchased.
Access may continue through the end of the applicable paid membership period.
Refunds
Membership payments are generally nonrefundable once a billing period has begun, except where required by law or where Blue By Ninety determines that a refund is appropriate.
Event, tailgate and merchandise purchases may be subject to separate refund, cancellation or fulfillment policies displayed at the time of purchase.
Club90 Content
Club90 articles, message board discussions and other premium material are provided for the personal use of active members.
Members may not reproduce, republish, distribute, sell, publicly post, screenshot for redistribution, or otherwise make member-only content available to nonmembers without permission from Blue By Ninety.
This includes information, analysis, reports and discussions posted within private Club90 areas.
Blue By Ninety may suspend or terminate access for intentional redistribution of premium or private content.
Message Board
Club90 members may be permitted to participate in the Blue By Ninety message board.
Users are responsible for what they post.
You may not use the community to:
- Harass, threaten or abuse other users.
- Post unlawful content.
- Impersonate another person.
- Publish another person’s private information without authorization.
- Spam or solicit users without permission.
- Attempt to circumvent membership restrictions or account security.
- Redistribute Club90-only discussions outside the community without authorization.
Blue By Ninety may moderate, edit, hide or remove content and may suspend or terminate community access when necessary to protect the community or enforce these Terms.
User-Submitted Content
You retain ownership of original content you submit.
By posting content to Blue By Ninety community features, you grant Blue By Ninety a nonexclusive license to host, display, reproduce and otherwise use that content as reasonably necessary to operate and moderate the service.
You represent that you have the right to submit the content you post.
Accounts
You are responsible for maintaining the security of your account and password.
Accounts are intended for individual use and should not be shared with other people.
Blue By Ninety may restrict or terminate an account involved in unauthorized sharing, fraud, abuse or attempts to circumvent membership restrictions.
Recruiting and Other Information
Recruiting information can change quickly. Commitments, offers, rankings and other recruiting information should not be considered final until officially confirmed by the relevant parties.
Blue By Ninety may publish information obtained from reporting, sources, public information and third-party data services.
Intellectual Property
Unless otherwise stated, Blue By Ninety’s branding, logos, original written content, graphics, podcasts and other original materials are protected by applicable intellectual property laws.
Nothing in these Terms grants permission to commercially reproduce or redistribute Blue By Ninety material without authorization.
Certain photographs, logos, statistics, embedded media and other materials may belong to their respective rights holders.
Third-Party Services
Blue By Ninety may integrate with or link to third-party platforms including Discourse, Stripe, Shopify, YouTube, Spotify and social media services.
Your use of those services may also be governed by their own terms and policies.
Advertising and Affiliate Relationships
Blue By Ninety may receive compensation from advertisers, sponsors, partners or affiliate relationships.
Sponsored or promotional material may be identified where appropriate.
Commercial relationships do not give advertisers control over Blue By Ninety editorial coverage.
No Guarantee of Availability
We may modify, suspend or discontinue portions of the website, membership service or community at any time.
We do not guarantee uninterrupted or error-free availability.
Limitation of Liability
To the maximum extent permitted by law, Blue By Ninety and its owners, employees, contributors and affiliates will not be liable for indirect, incidental, special or consequential damages resulting from use of or inability to use the website or services.
Termination
Blue By Ninety may suspend or terminate access to the site, Club90 or the community for violation of these Terms, fraudulent activity, misuse of the service or conduct that threatens the operation or integrity of the community.
Changes to These Terms
We may modify these Terms periodically. Continued use of Blue By Ninety following an updated version constitutes acceptance of the revised Terms to the extent permitted by law.
Governing Law
These Terms will be governed by the laws of the State of Michigan, without regard to conflict-of-law principles, unless applicable law requires otherwise.
